Afrion law firm Group Real Estate Litigation Attorney in Sierra Leone Lease Agreements

Afrion law firm Group Real Estate Litigation Attorney in Sierra Leone

A real estate dispute of any type can derail a project, a lucrative deal, or simply take up precious time and resources. Real estate transactions can be complex and are not “do-it-yourself” processes. Having a knowledgeable real estate attorney in your corner can save you time, effort, and money when making a transaction or navigating an issue that involves a piece of property.

At Afrion Law Firm, our legal team has comprehensive experience in handling all manner of residential and commercial real estate transactions, particularly those that are unique to Sierra Leone and West Africa markets. Over the years, we have established relationships with area banking institutions and real estate professionals, allowing us to provide a wide range of real estate legal services to clients. Unfortunately, not every transaction, project, or agreement goes as planned. When there are disputes, our qualified real estate attorneys can represent your interests in any type of litigation.

Real estate contracts generally contain several provisions, contingencies, and terms and conditions that all the parties involved in the transaction are expected to abide by. If one of the parties breaches the terms of the contract, the other parties might suffer financial losses.

Specific areas of our residential and commercial real estate litigation practice include:

Buy/Sell Disputes

One of the biggest investments an individual or business will make is in real estate, so errors in disclosure or title issues could lead to a serious legal dispute. If a property owner fails to disclose prior damage or defects or there are impediments to the title, you may become a party to litigation. The same holds true if you are a seller and are wrongly accused of attempting to mislead a buyer. Our firm can actively pursue collaborative resolutions to buyer-seller disputes, including breach of contract.

Boundary Disputes

According to Robert Frost, “good fences make good neighbors.” But, what if you can’t agree on where that fence should sit? Your land may be one of your most valuable assets, and there will be an understandable dispute if you and your neighbor disagree on boundaries. Whether in a residential or commercial setting, suing your neighbor is generally a last resort. Inaccurate or incorrect boundary lines can be thorny issues, but these disputes are surprisingly common. Our experienced real estate litigation attorneys can help you navigate these problems with the goal of reaching a fast and amicable resolution.

Construction Management Disputes

When you are building a home, commercial building, or undertaking major improvements, you should have a detailed construction agreement. In many cases, disputes will arise that should be covered in the contract, although this isn’t always the case. There may be problems related to time delays, material issues, design problems, payments, and other problems that constitute a breach of contract. We represent both property owners as well as contractors when misunderstandings or issues arise and strive to help our clients find common ground.

Easement & Restrictive Covenant Disputes

As a land or property owner, you may have spelled out the allowable uses for your property, such as a right-of way. When disputes arise from the use of another person’s property, or if the property is your own, you may benefit from a qualified legal opinion. You may also have unclear restrictive covenants that require clarification or other factors that need to be enforced. Our team of real estate
litigations attorneys can help.

Property owner/Tenant Disputes

Our real estate litigation practice handles all types of landlord-tenant disputes that range from contract and lease issues to rent-control and eviction problems. You may be a landlord that needs help with the enforcement of a lease, issuing eviction notices, collecting unpaid rent or utilities, or pursuing claims for property damages.
We can also protect the rights of tenants who are facing wrongful eviction, failure to return security deposits, failure to maintain premises or make repairs, or other
contract violations.

Mechanic’s Liens & Payment Bond Disputes

Having a mechanic’s lien cloud the title of your property can be aggravating for a home or building owner since it can prevent the sale or refinancing of that property. Likewise, contractors who haven’t been paid have the right to make a claim against general contractors or the property owner. Whether you are a property owner facing a mechanic’s lien claim or a subcontractor who needs to satisfy payment owed on a property, our real estate lawyers can help resolve your legal issues as quickly and
affordably as possible.

Other Real Estate Litigation Disputes

Our skilled and aggressive real estate lawyers can represent your interests across a
full spectrum of other property disputes:
● Zoning and land use planning
● Environmental regulatory compliance
● Licensing and permitting issues
● Oil, gas, and mineral rights
● Infrastructure permits and funding
● Warranty and misrepresentation claims
● Planned unit and condominium matters

Condemnation and Eminent Domain

One risk of owning real estate is that the government will one day knock on your door and tell you that they will be taking all or some of your property. The government can condemn your property as no longer being “legitimate” for use. They also have the right to pay you fair market value for the property, which often isn’t a good deal for the property owner. Fortunately, you do have some rights in these cases, and our aggressive real estate attorneys can explain your options.

Design & Construction Defects

When selling a property, the seller is legally obligated to tell the buyer whether the property has any material or latent defects. If they fail to do so, the buyer has the right to sue them and seek compensation. A material defect is one which can adversely impact the property’s value and/or pose a risk to those who reside in it. A latent defect, on the other hand, is a hidden defect which might not be visible to the naked eye and could not have been spotted by the buyer even after a reasonably thorough inspection. If the seller discloses these defects before the sale, the buyer might not be willing to pay the asking price or might not be willing to buy the property at all. By hiding these defects, the seller not only cheats the buyer out of their hard-earned money, but also puts the buyer’s life at risk. This is why the law allows buyers to sue sellers for failing to disclose such defects. Some common defects include electrical problems, window leaks, structural and foundation cracks, wood rot, roof leaks, mold, plumbing issues, and crumbling stucco. In some cases, both the designer as well as the builder of the property are responsible for the damages. If a builder or contractor has left you with a property marred by these problems, our construction defect attorneys will make the appropriate claims to protect your rights and property.
